AXSO Inc. ("AXSO", "we", "us", "our") provides this privacy policy (the "Policy") to inform users of the Eddie platform offering services for locating charging stations, planning trips, managing wallets, charging preferences and history, and paying for charging services at charging stations managed by AXSO or interoperable networks (the "Platform"). We therefore invite you to read its content carefully.
This Policy explains our practices regarding the personal information we collect when you use the Platform. The Policy does not apply to websites operated by third parties, in particular where:

You may withdraw your consent to the processing of your personal information, in whole or in part, at any time by writing to our Privacy Officer. Please note, however, that you may no longer be able to benefit from certain features of our Platform.
For the purposes of this Policy, "personal information" means any information about an identifiable individual, including any information that directly or indirectly identifies such individual. You are under no obligation to provide any personal information to use the Platform.

Analytics cookies are also used to help our Platform operate more efficiently during your visit. We use the information collected to assess the popularity of our pages, analyze traffic trends on our Platform and guide improvements. Finally, we use functionality cookies to provide you with enhanced functionality and personalization when browsing the Platform.
With the exception of essential cookies, we will only place cookies on your devices with your consent, and these cookies will be retained for a maximum period of thirteen (13) months from the time they are placed on your devices. You are under no obligation to agree to provide your geolocation data. Your consent will be required prior to the activation of the technology used to locate you. We use technologies that allow us to locate you when you activate the geolocation function on our Platform. You can refuse to be located at any time by modifying the settings on the Platform. You will then no longer be able to benefit from the trip planner and the identification of nearby charging stations.
We use analytical tools such as LocalStorage, Firebase and Google Analytics to analyze how you use our Platform. This information is stored by Google on servers that may be located outside the province of Québec, including in the United States. These tools and technologies collect and analyze certain types of data, including cookies. You can download the browser add-on to deactivate Google Analytics by following the procedure available at https://tools.google.com. In order to protect your personal information, we have implemented policies, practices and procedures relating to the management of the personal information we hold. These internal policies and procedures govern the collection, use, disclosure, retention, and destruction of personal information, as well as the handling of complaints, information security, and data governance at ASXO. They also provide the framework for the implementation of Privacy Impact Assessments, where required, as well as the prevention of and response to potential privacy incidents. All these policies and practices have been approved by our Privacy Officer. The collection of your personal information through our Platform complies with the requirements of this program.
The personal information we collect is kept confidential in accordance with the applicable privacy and data protection laws of the jurisdictions in which we do business. We follow generally accepted industry standards, and personal information in our possession is therefore accessible only to those persons who have the authority to access it, and who consult it only when necessary for the performance of their duties. We take reasonable administrative, technical, and physical measures to protect your personal information and minimize the risks of loss, confidentiality incidents, theft and unauthorized access, use, modification, and destruction. In addition, we do not collect your credit card information, only your credit card imprint. In addition, we use the following measures:
The Platform is not intended for persons under the age of 13. AXSO does not knowingly process personal information from children under the age of 13 unless a parent or legal guardian has consented. If you believe that personal information has been collected from children under the age of 13 without your prior consent, you may contact us as described in the "Who can I contact with questions about the Policy?" section.
Your personal information is accessible only to AXSO employees, agents, or suppliers whose duties require it.
Your personal information is handled by AXSO staff. We ensure that only authorized AXSO personnel have access to your personal information when necessary to manage our business relationship or to meet our legal obligations.
AXSO may share your personal information with its partners to the extent that such disclosure is required to fulfill the purposes described above. AXSO may use third parties to facilitate its activities, such as hosting service providers. In connection with these activities, AXSO's service providers may have access to and use of your personal information for a limited period of time. Where AXSO engages third parties to process any personal information, AXSO implements reasonable contractual and technical safeguards to ensure that such third parties maintain the strict confidentiality of any personal information they process. Please note that these third parties may be located in locations other than where you are located, in which case appropriate measures are taken by AXSO, as indicated below in the section "Is your personal information transferred outside Quebec?".
AXSO may also share your personal information if required to do so by law or we believe in good faith that such action is necessary to: (i) to comply to the law; (ii) comply to an order of a competent judicial authority, regardless of jurisdiction; (iii) comply to any legal proceeding served on AXSO; (iv) protect and defend the rights or property of AXSO; (v) enforce or verify your compliance with agreements you have entered into with AXSO, if any; (vi) prevent fraud or other illegal activity perpetrated through the Platform; or (vii) act under exigent circumstances to protect the personal safety of users of the Platform from the general public.
We may share your personal information without your authorization when our operations require it (in the event of a merger, acquisition, bankruptcy, or sale of assets, for example). In the event of such an event, we may also share some or all of your personal information with the third party concerned (or its advisors) as part of a due diligence process.
Where you have expressly consented, your personal information may be shared with other third parties. For example, there may be specific cases where additional conditions apply and, through these, we make it clear that specific third parties are processing your personal information.
We retain your personal information only for as long as is necessary to fulfill the purposes for which it was collected, in accordance with our internal document retention policies, to comply with applicable legal, tax, or regulatory requirements, until you ask us to destroy it. After such period, any relevant personal information we hold will be destroyed, deleted, or anonymized.
The personal information we collect is stored in secure systems hosted on servers that may be located outside Quebec, notably in Canada. We may also retain the services of service providers who may be located outside Quebec. However, we strive to protect personal information in our custody, including personal information entrusted to service providers, whether they are located in Canada, the United States or other jurisdictions or countries. In particular, we strive to limit their access to personal information to that which is necessary to perform the tasks entrusted to them. Please be aware that we also endeavor to put in place contractual agreements with our suppliers to ensure an adequate level of protection for personal information. No method of Internet transmission or electronic archiving is completely secure. Your messages can always be lost, intercepted, hacked, or destroyed.
